Kashamu lose Appeal on Extradition

A court sitting in Abuja on Tuesday, led by trial judge, Justice Okon Abang has dismissed an application by Sen. Buruji Kashamu, seeking a restraining order against the Department of State Services (DSS) from extraditing him to the U.S to face charges.

The court refused the application after Counsel to Kashamu, Mr Godswill Mrakpo, made the arguments in favour of his client’s prayer, Vanguard reports.

Justice Abang ordered that the third respondent should be served outside the jurisdiction of the court, while directing the applicant to file and serve the motion on notice on the Director-General of DSS, Inspector-General of Police and Mr Oladikupo Adebutu.

“It is my view that the court should give the respondents opportunity to show cause why restraining order should not be granted against them, Abang said.

“The court shall give them time to respond, I want to hear from the respondents.”

The Judge also refused another prayer seeking to serve the respondents through a substituted means, stating that the applicant did not place any material before the court to show he made any effort to serve the respondents, that proved abortive.

As a result, Justice Abang struck out the first and second reliefs sought by the applicant.

Senator Kashamu was asking the court to restrain all the respondents and their agents from arresting and extraditing him to the US where he’s facing drug charges.

The judge adjourned hearing till Sept. 8 to enable the applicant to properly serve all the respondents with motion on notice.
