#DasukiGate Goodluck Jonathan is a Vital Witness – Olisa Metuh
Chief Olisa Metuh, the Peoples Democratic Party National Publicity Secretary yesterday prayed an Abuja Federal High Court to dismiss the criminal charges preferred against him by the Economic and Financial Crimes Commission.
Onyechi Ikpeazu (SAN), Metuh’s lawyer stated this on behalf of his client when he filed a no-case-submission, that essentially seeks to quash the charges because the prosecution had failed to provide authoritative evidence to establish and solidify their accusations.
The PDP spokesperson is accused of receiving N400 million from embattled former National Security Adviser, NSA, Col. Sambo Dasuki.
The said money is alleged to have been paid to Metuh through his company, Destra Investments Ltd, before the 2015 general election and the Anambra politician has refused to state what the money given to him by former President Jonathan, was for.
His lawyer stated that: “In this case, by the evidence of PW-3, who works with ONSA, the NSA is answerable to then President Dr. Goodluck Jonathan only.”
“The PW-5’s evidence that presentation for which money was paid was made to Dr. Jonathan made the investigation of his role as well as his evidence vital and indeed crucial, without which no prima-facie case can conceivably be said to have been made out.”
“Dr. Jonathan to whom the presentation was made for which the payment was made is therefore a material and indispensable person in order for a prima-facie case to be present. Where the prosecution failed to call such a vital witness, a strong presumption will arise that the evidence, if called, would be unfavourable to the prosecution.”
